This agreement establishes the contractual relationship between you as a customer and TMKR Global, LLC. It details the terms governing your purchase and use of digital trading tools on TheMarket Robo platform.

1. Introduction and Purpose

This Customer Agreement ("Agreement") is entered into between you ("Customer," "User") and TMKR Global, LLC, operating as TheMarket Robo ("Company," "Platform"). This Agreement governs the commercial terms of the customer relationship, including the purchase of digital trading tools, licensing terms, payment obligations, and the mutual obligations of both parties.

This Agreement is supplemental to the Customer Terms of Service and should be read in conjunction with them. This Agreement covers the specific commercial terms, including purchase terms, licensing, refund policy, and operational obligations.

2. Account Registration and Eligibility

3. Purchases and Licensing

Purchase Overview

When you purchase a digital trading tool on our platform, you acquire a limited, non-exclusive, non-transferable license to use the product. You do not acquire ownership of the underlying intellectual property.

Upon successful payment, you are granted a limited, non-exclusive, non-transferable, revocable license to use the purchased product for your personal trading activities. The license duration and any account/device limitations are specified in the product listing at the time of purchase.

All purchases must be paid in full at the time of purchase. Prices are displayed in the currency specified on our website and are subject to change without notice. The price charged is the price displayed at the time of purchase completion. Applicable taxes may be added at checkout based on your location.

Once payment is successfully processed and the order status changes to "completed," the License is immediately activated and the transaction is final. No cancellations are permitted after order completion.

4. Refund Policy

NO CHANGE-OF-MIND REFUNDS

**DIGITAL PRODUCTS: ALL SALES ARE FINAL FOR BUYER'S REMORSE, CHANGE OF MIND, OR DISSATISFACTION UNRELATED TO NON-DELIVERY OR MATERIAL FAILURE.**

We do not refund because you changed your mind or dislike the product after purchase when access or performance has been supplied as described. Limited refunds may apply only as set out below and in our User Agreements (Section 6 — Refunds) (/user-agreements#no-refunds).

4.1 Digital Product Nature

All Products sold are digital. Once a License is activated and you have access, the sale is complete in the sense that you cannot "return" bits like physical goods. We do not refund for trading losses, market conditions, optional technical issues outside our reasonable responsibility, change of mind, or failure to achieve expected trading results.

4.2 When a Refund May Be Considered

We may issue a refund or subscription credit only in strict, verified cases of **non-delivery** of what you purchased or a **material** failure of the software or our delivery mechanism that we cannot resolve within a reasonable time after you cooperate with support—aligned with User Agreements Section 6. 4.3 Acknowledgment

By completing a purchase, you acknowledge this refund policy. You agree not to initiate payment disputes without first contacting our support team to resolve legitimate delivery or material failure issues. Nothing here limits non-waivable rights under applicable consumer law.

5. User Obligations

5.1 Lawful Use

You agree to use our platform and products only for lawful purposes and in accordance with these terms. You are solely responsible for ensuring that your use of our products complies with all applicable laws, regulations, and trading rules in your jurisdiction.

5.2 Trading Responsibility

You acknowledge that trading in financial markets carries significant risk. You are solely responsible for all trading decisions made using our products. Past performance of any product does not guarantee future results. You should only trade with funds you can afford to lose.

5.3 Compliance

You are responsible for compliance with all applicable laws and regulations in your jurisdiction, including but not limited to financial regulations, tax obligations, and trading restrictions. We do not provide legal, financial, or tax advice.

6. Intellectual Property

All digital trading tools, content, designs, logos, trademarks, and other materials on our platform are owned by TMKR Global, LLC or its vendors and are protected by intellectual property laws. Your license to use purchased products does not transfer any ownership of intellectual property rights to you. All rights not expressly granted in this Agreement are reserved.

7. Risk Disclaimer and Financial Warning

HIGH RISK WARNING

Trading in financial markets involves substantial risk of loss and is not suitable for all investors. Automated trading tools and algorithmic strategies do not guarantee profits and may result in significant financial losses. You should carefully consider whether trading is appropriate for you in light of your financial situation and risk tolerance.

We do not provide financial advice, investment recommendations, or trading signals. Product descriptions, performance data, and backtests are provided for informational purposes only and do not constitute financial advice. Past performance is not indicative of future results. You are solely responsible for your trading decisions and outcomes.

8. Limitation of Liability

**ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.** We make no warranties regarding product performance, trading outcomes, or platform availability.

To the maximum extent permitted by law, TMKR Global, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services, including but not limited to trading losses, lost profits, data loss, or business interruption.

You agree to indemnify and hold harmless TMKR Global, LLC from any claims, damages, or losses arising from your use of our products, including any trading losses, regulatory violations, or third-party claims.

9. Account Termination

9.1 Termination by Us

We may suspend or terminate your account at any time if we determine that you have violated these terms, engaged in fraudulent activity, or used our products in a manner that we consider harmful to the platform or other users. Termination for cause may result in permanent loss of access to purchased products.

9.2 Termination by You

You may close your account at any time by contacting our support team. Closing your account does not entitle you to any refund of purchased products. Existing licenses remain governed by their original terms.

9.3 Effect of Termination

Upon termination, your access to the platform and purchased products may be revoked. Provisions that by their nature should survive termination (including liability, intellectual property, and indemnification) shall survive.

10. General Provisions

10.1 Entire Agreement

This Agreement, together with the Customer Terms of Service, constitutes the entire agreement between the parties regarding the customer relationship.

10.2 Governing Law

This Agreement is governed by the laws of Georgia. Any disputes shall be resolved through binding arbitration in Tbilisi, Georgia, unless otherwise required by applicable consumer protection laws in your jurisdiction.

10.3 Severability

If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.

10.4 Modifications

We reserve the right to modify this Agreement at any time. Material changes will be communicated via email or through our platform with at least 30 days' notice. Your continued use of our services after such modifications constitutes acceptance of the updated Agreement.
